End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Git Insight ("Licensor") for the Git Insight plugin software ("Software").

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.

1. Definitions

  • "Developer" or "Licensor" means Kadochnikov Maksim, the creator and owner of the Plugin.
  • "User" or "You" means the individual or entity that installs or uses the Plugin.
  • "Plugin" or "Software" means the Git Insight plugin for JetBrains IDEs, including all updates, upgrades, and documentation.
  • "Subscription" means a time-limited license to use the Plugin and receive updates during the subscription period.
  • "JetBrains Marketplace" means the official plugin distribution platform operated by JetBrains.

2. Grant of License

Subject to the terms of this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the Software on devices where you have a valid JetBrains IDE license
  • Use the Software for your personal or commercial software development activities

3. License Restrictions

You may NOT:

  • Copy, modify, or distribute the Software except as expressly permitted
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
  • Remove, alter, or obscure any proprietary notices, labels, or marks on the Software
  • Sublicense, rent, lease, or lend the Software to third parties
  • Use the Software to develop a competing product
  • Use the Software in any way that violates applicable laws or regulations

4. Intellectual Property

The Software is protected by copyright laws and international treaty provisions. Licensor retains all intellectual property rights in the Software. This Agreement does not grant you any rights to trademarks or service marks of Licensor.

5. Subscription and Updates

  • Access to Software updates is subject to an active subscription as defined by JetBrains Marketplace terms
  • Licensor may release updates, patches, or new versions at its discretion
  • Certain features may require a paid subscription

6. Data Collection

The Software processes Git repository data locally on your machine. See the Privacy Policy for details on data handling.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.

Upon termination, you must:

  • Cease all use of the Software
  • Delete all copies of the Software from your devices

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

11. Entire Agreement

This Agreement constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior agreements and understandings, whether written or oral.
